General Terms and Conditions of Sale

These General Terms and Conditions of Sale (hereinafter "GTC") govern the contractual relations between the company GRIFFON and any natural or legal person making a purchase via the GRIFFON website (hereinafter the "Client").
Any order placed on the site implies unconditional acceptance of these GTC.

ARTICLE 2 – SCOPE OF APPLICATION
These GTC apply to all sales of products marketed by GRIFFON on its website www.griffon1950.com, intended for private and professional clients, in France and internationally.
Certain provisions (notably the right of withdrawal) apply exclusively to consumers within the meaning of the Consumer Code.
ARTICLE 3 – PRODUCTS
The products offered for sale are those listed on the site on the day of the Client's consultation.
Each product is presented with as precise a description as possible. Photographs, visuals, colors, and staging are provided for information only and cannot constitute a contractual commitment, especially due to possible color rendering variations depending on screens.
GRIFFON reserves the right to modify its product offer at any time.
ARTICLE 4 – QUOTES AND ORDERS
The Client creates a quote directly on the GRIFFON website.
A quote sent directly by the Provider is valid for 30 days from its dispatch (excluding specific conditions specified in the quotes). To place an order, the Client returns the dated and signed quote bearing the handwritten note "Approved and acceptance of the GTC." Signing the quote constitutes a firm and final commitment by the Client.
The Client places an order directly on the GRIFFON website.
Any order implies acceptance of the prices, product descriptions, and these GTC.
The sale is considered final after:
- the validation of the order by the Client,
- the acceptance of payment,
- the order confirmation sent by GRIFFON by email.
GRIFFON reserves the right to refuse or cancel any order in case of an existing dispute with the Client or non-payment.
Any order modification requested by the Client can only be considered if received in writing and before the products are shipped.
ARTICLE 5 – PRICES
Prices shown on our quotes are based on the rates in effect on the date of the proposal and are indicated in euros (€), excluding tax (excl. VAT) or all taxes included (incl. VAT) depending on the Customer’s profile, excluding delivery fees.
Delivery fees are indicated before the final confirmation of the order.
GRIFFON reserves the right to change its prices at any time, provided that the price charged will be the one in effect at the time of the order.
All our prices are set ex-works (excluding special conditions specified in price lists, quotes, and order acknowledgments, etc.).
Our prices are set EXWORKS for export (excluding special conditions specified in price lists, quotes, and order acknowledgments, etc.).
ARTICLE 6 – PAYMENT TERMS
Order confirmation constitutes a payment obligation.
On the Site, the Customer has the option to pay:
- By credit card. The Site has a reinforced protection system against fraudulent use of the Customer’s credit card. The card is debited upon payment validation, which is sent by email and corresponds to 100% of the confirmed order.
- By bank transfer. The Customer receives an email specifying the Provider’s bank details. The order will only be processed upon full receipt of payment in the Provider’s account. Please specify the associated order number in the transfer reference.
- Installments with no fees (see dedicated paragraph)
ARTICLE 6.1 – INSTALLMENT PAYMENT TERMS WITH OUR PARTNER ALMA
The Seller offers its Customers the Alma credit service for payment of their purchases and execution of payment. This is subject to the Customer’s acceptance of the TOS or the credit agreement offered by Alma.
Any refusal of credit approval by Alma for an order may result in its cancellation.
Any termination of the GTC binding the Customer and the Seller results in the termination of the TOS or the credit agreement between Alma and the Customer.
Payment in three or four installments is available through our partner Alma. Payment security is ensured by Alma and its service providers. All payments are protected by 3D Secure.
Purchase amount: Only purchases between €200 and €2000 are eligible for payment with Alma.
Fees: When paying in installments with Alma, the Customer pays no fees. Alma is the payment manager and issues an electronic certificate that will serve as proof of the amount and date of the transaction in accordance with the provisions of articles 1316 and following of the Civil Code.
Termination: Any termination of the GTC binding the Seller and the customer results in the termination of the TOS between Alma and the customer.
ARTICLE 6.2 – PENALTY CLAUSE – COMPENSATION
Unless expressly agreed in writing in advance by the Provider, and provided that claims and debts are certain, liquid, and payable, no compensation may be validly made by the Customer between any penalties for delay in the supply of Goods or non-compliance of the order, on the one hand, and amounts owed by the Customer to the Provider for the purchase of the Goods, on the other hand.
ARTICLE 7 – MANUFACTURING AND AVAILABILITY
GRIFFON products are mostly made to order or in limited series.
Products are delivered to the delivery address provided by the customer on the order form.
Manufacturing and availability times are provided as an indication at the time of order. Any delay beyond the indicated time cannot give rise to damages or order cancellation, except as otherwise provided by law.
ARTICLE 8 – SHIPPING AND DELIVERY POLICY
8.1 Delivery zones
The delivery cost is indicated to the Customer before order confirmation. GRIFFON delivers its products in mainland France and internationally. Certain areas may be subject to specific conditions or personalized quotes.
8.2 Delivery times
Delivery times include:
- the manufacturing or preparation time,
- the transport time.
Deadlines are provided as an indication and may vary depending on the destination, the nature of the product, and logistical constraints.
8.3 Delivery terms
Delivery is made to the address provided by the Customer at the time of order, on the ground floor or at the building entrance, unless otherwise specified. The carrier partner schedules an appointment with the Customer before delivery.
The Customer agrees to verify the accessibility of the delivery location (dimensions, access, floors, elevator).
Spare parts are delivered to a pickup point chosen by the Customer on the Site during order confirmation. The Customer is informed by email or SMS of the parcel tracking information. It is then the Customer's responsibility to collect their order within the timeframe specified by the carrier. After this period, the products will be returned to the Provider, who may, upon the Customer's request, refund the order, excluding shipping and return costs and provided that the products are in a condition suitable for restocking.
8.4 Receipt of products
The Customer is required to check the condition of the products upon delivery.
Any anomaly (damaged package, missing or damaged product) must be:
- reported to the carrier on the delivery note in the form of precise and specific reservations. It is specified that any reservation such as "subject to unpacking" has no value; if the delivery person refuses to assist with unpacking, this must be noted on the carrier's receipt. These reservations must necessarily concern the contents and not the packaging.
- confirmed to GRIFFON in writing at the address contact@griffon.fr on the same day and sent within three days by registered letter with acknowledgment of receipt to the company headquarters.
Otherwise, the products will be deemed compliant and no claim can be accepted.
8.5 Delivery fees
Delivery fees are calculated based on volume, weight, destination, and mode of transport, and are indicated before order confirmation.
In case of unsuccessful delivery due to the Client (absence, incorrect delivery address, etc.), re-delivery fees will be charged to the Client.
ARTICLE 9 – RETENTION OF TITLE CLAUSE
In accordance with Law No. 80-335 of May 12, 1980 (reproduced by Article 121 of Law No. 85/98 of January 25, 1985), the goods delivered remain the property of the Service Provider until full payment and the Service Provider may repossess their goods in case of Client default. Failure to pay any installment may result in the claim of all delivered goods.
To invoke this clause, it will be sufficient for the Service Provider to formally express their wish to have the goods returned by a simple registered letter with acknowledgment of receipt sent to the Client. It is expressly specified, however, that the Client will be responsible for the goods placed in their hands upon physical delivery, as the transfer of possession entails the transfer of risks for which all insurances must be taken out.
ARTICLE 10 – RIGHT OF WITHDRAWAL (CONSUMER CLIENTS)
In accordance with Articles L221-18 and following of the Consumer Code, the consumer Client has a period of 14 days from receipt of the products to exercise their right of withdrawal without having to justify reasons or pay penalties.
If the fourteen (14) business day period expires on a Saturday, Sunday, public holiday, or non-working day, it is extended to the next business day.
However, this right does not apply to products made to measure, personalized, or made according to the Client’s specifications.
In the event of exercising the right of withdrawal, the Client must send an email to the Service Provider specifying their request to exercise the right of withdrawal as well as their order information. The Service Provider will then acknowledge receipt of this request and proceed to recover the products. Subject to the products being received in proper condition, the Service Provider will refund the Client’s order, deducting the return shipping costs which remain the Client’s responsibility. For proper handling, the Product must be returned complete, in its original condition and original packaging. Products that are damaged or incomplete will not be accepted.
The right of withdrawal does not apply to the Professional Client.
ARTICLE 11 – WARRANTIES AND LIABILITIES
The Provider applies to the Individual Client the provisions of the legal warranty of conformity of the Product to the contract under the conditions of Article L211-4 and following of the Consumer Code.
The Individual Client:
- benefits from a period of two (2) years from the delivery of the Product to take action.
- may request the replacement of the defective part or Product if repair is impossible. In all cases, the Client must contact customer service to determine the warranty conditions and coverage;
- is exempt from proving the existence of the Product's non-conformity defect during the eighteen (18) months following the delivery of the Product, except for second-hand goods.
These provisions cannot be invoked by the Professional Client.
Warranty against hidden defects: The Individual Client may choose to invoke the warranty against hidden defects of the sold item under Article 1641 of the Civil Code. In this case, they may choose between canceling the sale or a reduction in the sale price in accordance with Article 1644 of the Civil Code.
For the Professional Client, the Provider applies a warranty against hidden defects of the goods for a period of two (2) years from delivery. The Provider is then only obliged to exchange the defective parts. The return shipping costs for defective parts are the responsibility of the Professional Client. Under no circumstances can the Client claim the cancellation of the sale of the goods in question, a price reduction, or any compensation of any kind.
In case of direct or indirect damage resulting from non-compliant use of the products or poor installation, the Provider's liability cannot be engaged. For any proven liability, it will not exceed the total pre-tax amount of the order.
To benefit from the warranty, the Client must keep the product invoice, packaging, and all product accessories.
The Provider's liability cannot be engaged for any delays, errors, damages, or any other defects in fulfilling its obligations in cases of force majeure, which includes, for example, strikes, acts of war, equipment failures, etc. The Provider declines all responsibility for any issues that may arise following the implementation or defective application of any product sold by it, provided that the buyer has not expressly submitted a written request for information regarding the implementation or application of said product or has carried out incorrect assembly, defective maintenance, or abnormal use.
To ensure the proper functioning of the GRIFFON toilet, it is necessary to use exclusively the drop pipe supplied with The Tube. This pipe has been designed to guarantee the proper operation of the entire installation; the warranty will not apply if installed with another drop pipe.
The Customer can contact the Provider's Customer Service by email, postal mail, or phone, using the contact details on the Customer's invoice.
Article 11.1 – Free 10-year warranty extension
In addition to the legal conformity warranty and hidden defects warranty, Griffon offers its customers a free 10-year total warranty extension (in addition to the legal 2-year warranty) on eligible products (L’Original tank and The Tube tank), subject to the following conditions:
- Eligibility conditions: The warranty extension is reserved for purchases made by a private or professional customer for personal or private use, not subject to intensive collective use or high-frequency rental use (tourist furnished rentals, seasonal rentals, public establishments, holiday cottages, hotels, restaurants, professional offices or premises).
- Only products explicitly mentioned above as eligible for the warranty extension can benefit from it.
- Mandatory activation: To benefit from the extension, the customer must register their product online via the dedicated form available on the site www.griffon.fr/garantie-griffon-enregistrement, within 6 months (180 days) from the purchase date. The registration must include: the product serial number, the purchase invoice, and the customer's full contact details.
- Activation confirmation: Once the registration request is validated by our services, the customer receives a confirmation by email, which serves as proof for the duration of the extended warranty.
- Warranty exclusion: If registration is not completed within the specified time, only the legal 2-year warranty will apply. Any incomplete or incorrect declaration may invalidate the extension. The extension does not cover defects related to improper installation, non-compliant use, or lack of maintenance. Wear parts and spare parts are not covered by the warranty extension; these parts are guaranteed for 2 years.
ARTICLE 12 – PERSONAL DATA
The personal data collected is processed in accordance with the privacy policy available on the website.
ARTICLE 13 – INTELLECTUAL PROPERTY
All elements of the GRIFFON site (texts, images, logos, graphics, models, illustrations, photos, videos) are protected by intellectual property law. Any unauthorized reproduction or use is strictly prohibited under penalty of legal action.
ARTICLE 14 – APPLICABLE LAW AND DISPUTES
In case of a dispute related to an order, the customer will first contact the Service Provider to agree on an amicable solution. Failing that, the only competent courts are those of SAINT-ÉTIENNE (France), which have territorial jurisdiction regardless of the defendant's domicile. This contract is governed by and subject to French law, which is the applicable law in case of dispute.
ARTICLE 15 – ECO-CONTRIBUTION CLAUSE
We include an eco-contribution in our prices in accordance with Article L 541-10-1 4° of the Environmental Code, the amount of which is calculated based on the product purchased. This contribution helps finance the collection and treatment of waste from construction sites by encouraging sorting, reuse, and recycling. The portion of the unit cost that GRIFFON bears for the management of PMCB waste, as invoiced by the eco-organization to which GRIFFON belongs, is fully passed on to its customers without any discount. GRIFFON's IDU number is FR350650_04OIIR.
ARTICLE 16 – RETURN POLICY
16.1 General Principle
At Griffon, each product is designed with high standards and made to last. Our toilets are conceived as decorative and technical objects, crafted with care, often according to precise customization choices. This return policy aims to clearly and transparently define the conditions under which a product can be returned or exchanged. This policy applies to all customers, without distinction between private individuals and professionals.
16.2 Right of Withdrawal
In accordance with the provisions of Articles L221-18 and following of the Consumer Code, the right of withdrawal can be exercised within 14 days from the receipt of the product.
Exception – Customized Products
In accordance with Article L221-28 of the Consumer Code, the right of withdrawal does not apply to personalized or custom-made products. Products considered personalized include:
- products made in a specific color,
- products made according to a specific finish or configuration choice,
- any order involving manufacturing dedicated to the customer's request.
Any customized Griffon product cannot be returned, exchanged, or refunded, except in cases of proven defect or non-compliance.
16.3 Products Not Eligible for Return
- customized or made-to-measure product,
- product installed, used or modified,
- product returned incomplete or damaged after delivery,
- product returned without prior agreement from Griffon.
16.4 Defective or non-compliant products
Despite the care taken in manufacturing and shipping, if a product shows:
- a manufacturing defect,
- non-compliance with the order,
- damage related to transport, if you notice that one of the delivered products is damaged and/or broken, refuse the delivery and write “damaged product” or “broken product” on the delivery note. Then write to us at contact@griffon.fr within 48 hours of receiving your order.
16.4.1 Reporting deadline
Any anomaly must be reported within a maximum of 48 hours after receipt of the product and sent to the following email address: contact@griffon.fr. The request must be accompanied by:
- the order number,
- a precise description of the problem,
- photographs allowing the assessment of non-compliance or defect,
- the purchase invoice.
16.5 Return conditions
No return will be accepted without prior written approval from Griffon.
If a return is authorized:
- the product must be returned in its original packaging, carefully protected,
- the product must be in perfect condition, unused and uninstalled,
- return costs will be specified when the request is validated. In case of a defect or error attributable to Griffon, return costs will be covered by Griffon.
16.6 Refund or replacement
Depending on the situation, Griffon may offer:
- a product replacement,
- or a refund, made via the original payment method.
The refund, if applicable, will be made within a maximum of 14 days from the final validation of the return by Griffon.

16.8 Modify my order after receipt
If you wish to modify your order after receiving it, you have a period of 14 days from the receipt of the product to make your return request by writing to us at contact@griffon.frThe costs and organization of the return are your responsibility, and a modification fee of €100 will be applied.
We then need a period of 14 business days from the receipt of your item in our warehouses to proceed with the inspection of the returned items' condition. If they are all compliant, we will then get back to you to arrange the delivery of the new desired products as soon as possible. The shipping costs for this new shipment will be charged to you.
